Posted May 16, 2014 (Patch 5.4.8)The cloak is auto-upgraded to 2/2 for the player. In Patch 5.4.8, the legendary cloaks will have an additional two upgrades available -- but will not be automatically upgraded to 4/4.

Purgatory temporarily absorbs the amount of damage that would have been taken, but if that absorption is not healed through within the 3 second duration, the death knight dies. This cloak effect does not have that downside.
